N2 - As the United States has engaged in record levels of incarceration, there has been a concomitant rise in the number of persons incarcerated afflicted with severe mental illness (SMI) including schizophrenia, bipolar disorder, and major depression. Legislation aimed at diverting SMI persons away from incarceration and toward treatment has been recently developed. This paper reviews the Mentally Ill Offender Treatment and Crime Reduction Act of 2004 (MIOTCRA), and the potential of outpatient commitment laws to work in tandem with the experimental mental health courts program the MIOTCRA of 2004 helped to create.
